Do
I need a Divorce Attorney?
A very large
number of people have come in and said to me, "I really made a huge
mistake. I went to court without a divorce attorney and: A. My spouse was not
truthful and terrible orders were entered against me, or B. My spouse showed up
with an attorney and terrible orders were entered, or C. My spouse was much
more eloquent than myself and I panicked and terrible orders were entered against
me.
Is this a Community Property State?
No. A "Community Property
State" is 50/50. In Colorado we have what is called "Equitable
Division", which means you should discuss your particular circumstances
with an attorney to see whether an argument should be made to divide property
or debt disproportionately in your divorce.
Can I do my own divorce?
Many people do but there is not a
lot of assistance that you will receive from the court or the court clerks so
you need to have a lot of time and confidence in your abilities to do so. We
can help and give you the links to the State of Colorado required forms and
guidelines.
Can I afford an attorney?
The real question is "Can you afford not to have an attorney?” Undoing
divorce decisions made by the judges after the fact can be very difficult. We
utilize paralegals to the maximum extent possible because of the fact that in
Family Law there is a lot of repetition in each case which lends itself to the
effective utilization of paralegals. Our paralegals
here average 20 years of experience. Based on all of the above plus discounted
fees - it won't be inexpensive but will be much less than it would be for the
same caliber service elsewhere.

Put very simply, the goal of
Collaborative is to eliminate litigation and to eliminate a judge who knows
nothing about you or your family from making decisions that affect you and your
family for the rest of your life based upon the belief that it is in the best
interest of the family if the parties can avoid litigation and agree on a
settlement outside of the Courtroom.
Collaborative Law exists in between Mediation and Litigation. Although in
Collaborative Law each party is represented by a divorce lawyer both attorneys agree that in the event they
are not successful in helping the parties reach a settlement both attorneys
employment terminates.
We have completed the required training to offer Collaborative Law services to
our Clients. We also offer Mediation
and Mediation-Arbitration services; all with the intent to avoid costly legal
divorce battles in Court.

Do It Yourself Divorce
DO-IT-YOURSELF Our
DO-IT-YOURSELF program was created for individuals who do not want to hire a
divorce attorney or cannot afford to hire a divorce lawyer and believe they can
reach binding agreements outside of the Courtroom, without the intervention of
a judge and without the involvement of lawyers. These individuals are in
agreement on most matters but want to make certain that all Court required forms
are submitted and completed properly.
Uncontested Divorce
If the case is truly an UNCONTESTED divorce our DO-IT-YOURSELF program allows
the parties to work with a Family Law Mediator who meets with both parties, explains
the legal process, prepares all Court required forms on behalf of both parties
and coaches the parties on all required Court appearances. The Family Law Mediator is a neutral third party
bound to confidentiality. Although the Family Law Mediator cannot give legal
advice to either party, the expertise of the Mediator in Family Law allows the Mediator to alert the parties in
situations where agreements they intend to make conflict with the law or would
not be enforceable if challenged at a later date.
Our DO-IT-YOURSELF program is most
frequently used by spouses getting a Divorce or Legal Separation and by parents who were never married but have a
child from their relationship to file a Parental
Responsibility action..
Children and Divorce
In Divorce, Legal Separation and
Parental Responsibility Actions the children are truly the innocent victims
affected in varying degrees by the choices and actions of their parents. No
matter how amicable the separation or divorce of Mom and Dad is, there is
disruption for the children. In relationships that involve abuse (physical and
mental), alcoholism, infidelity, mental illness and/or high conflict, it is
often better for the children to experience the immediate disruption of divorce
rather than to continue to live under the existing conditions.
